GLOUCESTER TOWNSHIP FORCED TO DEFEND WITHHOLDING RECORDS IN POLICE DATABASE ABUSE CASE

Gloucester Township is being forced to defend its refusal to release records tied to a police department employee terminated for misusing law enforcement databases.

The underlying incident isn’t in dispute.
The termination isn’t in dispute.

What is in dispute is what happens next. When asked for records showing the outcome, the Township indicated that no records exist, while also asserting that any such records would be confidential. Those positions are now being challenged in a formal complaint before the New Jersey Government Records Council.

The Township will now be required to submit a certified response explaining its denial, including what records were searched for, what exists, and why anything is being withheld from the public.

Under New Jersey law, the burden isn’t on the public.

It’s on the Township to justify why the records aren’t being released.
